Customer Privacy Policy
1. PURPOSE
This Customer Privacy Policy applies to the processing of personal information by Apotex Pty Limited ABN 52 096 916 148 (Apotex) in Australia. Apotex provides pharmaceuticals and services to health care professionals.
2. SCOPE
In providing these services, Apotex collects personal information. The following policy sets out how Apotex manages personal information to meet its obligations under the Privacy Act 1988 (Cth) and the National Privacy Principles. Some of Apotex's actions with respect to employee records are exempt from regulation under the Privacy Act.

3.1We respect your right to privacy
3.1.1 Apotex recognises the importance of the privacy of individuals. This Customer Privacy Policy aims to allow individuals to make their own choices about how we use their personal information.
3.1.2 This policy complies with the requirements of the Privacy Act 1988 (Cth).

As outlined in Apotex Code of Conduct (Sections 1 and 4). The directors and employees of Apotex are bound by the laws of the country in which they operate and the security and proper use of customer information is mandatory.
5. GUIDELINES
5.1 Our business
5.1.1 Apotex may maintain databases on healthcare providers, including pharmacies, general medical practices and specialist medical providers. These databases are used for a number of purposes by Apotex directly and by contractors, including sales representatives, on behalf of Apotex. For example, these records are used to:
- Keep a record of our customers and their sales and dispensing information;
- provide our customers with information about products and services they may be interested in;
- make contact with our customers, such as when a product recall has been announced; and
- make available to our customers samples of new products which may be of interest to those practitioners.
5.2 Collecting personal information
5.2.1 Most of the personal information which we collect is professional information relating to pharmacists and healthcare practitioners. This information does not relate to individual patients. The kind of personal information which we may collect includes:
- professional's name;
- general contact information such as address, telephone and fax;
- professional practice information, such as year of graduation;
- professional information which individuals provide directly to us, such as areas of their professional interest;
- information about their own pharmacy, such as purchase and dispensing patterns; and
- information about the professional's preferences about how they should be contacted for professional purposes.
5.2.2 Most of the personal information which we collect comes directly from those professionals, or is subsequently confirmed with those individuals before being entered into our main databases.
5.3 We guarantee that we do not collect patient information
5.3.1 Apotex gives an absolute assurance that it does not seek or retain individual patient information in its communications with healthcare professionals. In the extremely rare situation where we are mistakenly provided with any information which identifies a patient, Apotex's policy is to return the information immediately to its source or destroy the information.
5.4 How we use personal information
5.4.1 The main use which Apotex has for personal information is to maintain a database of our customers which we use as set out in paragraph 5.1.1 above.
5.4.2 Apotex does not otherwise use or disclose any information about individuals without their consent, unless:
- required by law;
- we believe it necessary to provide an individual with a service which they have indicated they wish to receive, such as product updates;
- to protect the rights, property or personal safety of any member of the public or Apotex; and
- the assets and operations of our business are transferred to another party as a going concern.
5.5 We will not ‘spam' you
5.5.1 We may contact you at the email, fax or other address which you provide to us
in order to:
- provide you with urgent communications regarding our products, or
- provide you with other information about products and services in which you may be interested.
5.5.2 However, we will comply with our obligations under Spam Act 2003 (Cth).
5.6 Do Not Call Register
5.6.1 We may contact you on any telephone number which you provide to us in order to provide you with information about our products and services.
5.6.2 However, we will comply with our obligations under the Do Not Call Register Act 2006 (Cth).
5.7 You can access the information we keep about you
5.7.1 If at any time you want to know exactly what personal information we hold about you, you are welcome to access your record by contacting us using the details set out in item 5.13 below. Our file of your information will generally be made available to you within 14 days of us receiving your request.
5.8 Changing and deleting the information we have about you
5.8.1 If at any time you wish to change personal information that is inaccurate or out of date, please contact us using the contact details set out in item 5.13 below and we will amend your record. If you wish to have your personal information deleted, please let us know in the same manner as referred to above and we will take all reasonable steps to delete it unless we are compelled by law to keep it.
5.9 Storage and security of your personal information
5.9.1 Apotex will endeavour to take all reasonable steps to keep secure any information which we hold about you, and to keep this information accurate and up to date. Your information is stored on secure servers that are protected in controlled facilities or in hardcopy paper records stored in secure access facilities. We require our employees and data processors to protect the confidentiality of any personal information held by Apotex.
5.10 Our web site
5.10.1 Apotex does not collect personal information from visitors of this website. Future services or offerings available on this website may require personal information to be collected. If this is the case in the future users will be notified of the purpose for the collection and intended use of the information.
5.10.2 Cookies are pieces of data that a Website transfers to a user's hard drive for record-keeping purposes. Web beacons are transparent pixel images that are used in collecting information about website usage, email response and tracking.
