Eligibility
Eligible countries are defined in a series of schedules that can be
accessed directly through the CAMR website:

Instructions vary slightly depending on a country’s World Trade
Organization (WTO) status however, most countries with ‘Least
Developed Nation’ status under the United Nations classification
will be contained in these schedules.
Please refer to the schedules to identify the appropriate steps for
each country.
In principle, the CAMR requires that eligible countries first make a
formal request to the TRIPS Council of the WTO. They must state the
need for the specific product, that there is not sufficient local
manufacturing capacity to make the product in their country. Also
that the government intends to issue a compulsory license for the
product should patents be in force during the timeframe of the
request. The specific steps for the process as well as draft letters

Copies of all letters sent to the TRIPS Council should be forwarded
to Apotex to the attention of: Bruce Clark, so that they can be
included in our formal application to the Canadian Government. In
addition, an email notification to Apotex should be made to ensure
that we are advised of the request.
